DW ONLINE STORE TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your access to and use of the website https://shop.digitalwhisperers.co.za/ (“Website”) and any purchases of goods from DW Online Store (“we”, “us”, “our”). By accessing the Website or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website or place an order.

These Terms must be read together with our Privacy Policy. DW Online Store is an online retailer of garden supplies, seeds, fertilisers, pet products and related items, operating via the OpenCart platform.

1. SUPPLIER INFORMATION (ECTA Section 43)

In accordance with the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”), we provide the following information:

Full prices (including applicable taxes where shown) and delivery costs are displayed before you complete your order. Payment methods, delivery times, return/refund policy, security procedures and our Privacy Policy are set out in these Terms or linked on the Website.

2. ELIGIBILITY AND ACCOUNT

You must be 18 years or older (or have parental/guardian consent) to place an order. You may browse the Website without an account. If you create an account, you are responsible for keeping your login details secure and for all activity under your account. Automated registrations or the use of bots are prohibited.

3. ORDERS, PRICES AND PAYMENT

All orders are offers to purchase and are subject to acceptance by us. We may refuse or cancel an order for any legitimate reason (including stock unavailability, pricing errors or suspected fraud).

Prices are displayed in South African Rand (ZAR) and exclude VAT, unless otherwise stated. Delivery charges (if any) are calculated and shown at checkout. Free shipping applies to orders over R1 000 (or as otherwise advertised). Prices and promotions may change without notice, but the price confirmed at checkout applies to your order.

Payment is processed securely via the payment methods offered at checkout (PayFast). We do not store full card details. Ownership of goods passes to you only once we have received full payment and the goods have been delivered.

Before finalising an order you will have the opportunity to review the entire transaction, correct any errors, and withdraw from the transaction.

4. DELIVERY

We deliver throughout South Africa by courier. Estimated delivery time is 3–5 working days after dispatch (or as indicated at checkout), subject to stock availability and courier performance. You may also arrange collection where offered.

Risk in the goods passes to you on delivery (or collection). Please inspect goods on receipt and notify us promptly of any damage or shortage. We aim to dispatch orders as quickly as possible and will keep you informed of any significant delays. Under ECTA, unless otherwise agreed, we must execute the order within 30 days.

5. RETURNS, REFUNDS AND COOLING-OFF RIGHTS

ECTA Cooling-off (Section 44): For most electronic transactions for goods, you may cancel the transaction without reason and without penalty within seven (7) days after the date of receipt of the goods. The only charge that may be levied is the direct cost of returning the goods. We will refund payments within a reasonable time (normally within 30 days of cancellation and return of goods in good condition).

Certain goods may be excluded from the cooling-off right where permitted by ECTA (e.g. goods that by their nature cannot be returned, sealed goods opened by the consumer where health/hygiene is an issue, or custom-made items).

Consumer Protection Act (CPA) rights: You also have rights under the CPA, including:

  • The right to return goods that are defective, unsafe or of poor quality within six (6) months of delivery for repair, replacement or refund (at your choice, subject to the CPA);
  • The right to inspect goods on delivery and refuse delivery if they do not conform to the description or are unsuitable;
  • Other return rights under CPA sections 19 and 20 (e.g. goods not examined before delivery, or unsuitable for a particular purpose communicated to us).

To return goods, contact us at info@digitalwhisperers.co.za with your order number and reason. Goods must generally be returned unused, in original packaging where possible, and in resalable condition (except for defective goods). Return shipping costs are borne by you for cooling-off cancellations and by us for defective/CPA-qualified returns, unless otherwise agreed.

Refunds will be processed to the original payment method where possible.

6. PRODUCT DESCRIPTIONS AND AVAILABILITY

We take care to ensure product descriptions, images and prices are accurate. However, minor variations may occur and we reserve the right to correct errors. Stock availability is not guaranteed until the order is confirmed and paid for. If an item becomes unavailable after you order, we will notify you and offer a refund or suitable alternative.

7. INTELLECTUAL PROPERTY

All content on the Website (including text, images, logos, product descriptions and design) is owned by or licensed to Digital Whisperers and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute or use any content for commercial purposes without our prior written consent. You are granted a limited, non-exclusive licence to access and use the Website for personal, non-commercial shopping purposes only.

8. ACCEPTABLE USE

You agree not to:

  • Use the Website for any unlawful purpose;
  • Attempt to gain unauthorised access to the Website, accounts or systems;
  • Upload or transmit viruses, malware or harmful code;
  • Scrape, crawl or use automated means to extract data without permission;
  • Impersonate any person or entity or harass others;
  • Interfere with the proper working of the Website.

We may suspend or terminate access for breach of these Terms.

9. PRIVACY

Your personal information is processed in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (POPIA). By using the Website or placing an order you acknowledge our Privacy Policy.

10. DISCLAIMER AND LIMITATION OF LIABILITY

The Website and goods are provided on an “as is” and “as available” basis. To the maximum extent permitted by law (including the CPA), we exclude all warranties not expressly stated in these Terms or required by law.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited or excluded under South African law (including the CPA).

Subject to the above, our total liability to you in connection with any order or use of the Website is limited to the total amount paid by you for the relevant goods. We are not liable for indirect, incidental, special or consequential damages, loss of profits, data or business opportunities, except where such limitation is prohibited by law.

11. INDEMNITY

You agree to indemnify and hold DW Online Store and its officers, employees and agents harmless from any claims, losses, damages, costs or expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or violation of any law or third-party rights, to the extent permitted by law.

12. TERMINATION

We may suspend or terminate your access to the Website or cancel orders if you breach these Terms or for other legitimate reasons. Provisions that by their nature should survive (including intellectual property, limitation of liability, indemnity and governing law) will continue to apply.

13. DISPUTE RESOLUTION AND GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising out of or in connection with these Terms or your use of the Website/orders will first be attempted to be resolved amicably. If unresolved, the matter may be referred to mediation or, failing that, to the courts of South Africa (or arbitration if mutually agreed).

Nothing in this clause affects your rights to approach the National Consumer Commission, Consumer Goods and Services Ombud, or other competent authorities under the CPA or ECTA.

14. NOTICES

Notices to us must be sent to info@digitalwhisperers.co.za or any physical address we publish. Notices to you may be sent to the email or address provided in your order or account. Electronic notices are valid under ECTA.

15. GENERAL

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and us regarding the Website and purchases (subject to mandatory consumer rights). We may update these Terms from time to time; the version published on the Website at the time of your order applies to that order. Continued use of the Website after changes constitutes acceptance of the updated Terms.
